Hello Student Services Commission Model Conduct Code Work Group,

Probably should come up with an acronym for that. Anyway, hope you are all well this afternoon and I just wanted to touch bases on some possible days and times we could convene to scope out the work we need to complete for updating our model conduct code. 

Here are some possible days/times:

July 14  - 8 am or any time after noon
July 15 - 8 am or any time after noon

Bruce Marvin will be out, I believe, until sometime around July 15 or shortly thereafter. In the meantime, we can get busy on some of the work. After talking with Bruce, I do not think this needs to be a heavy lift so let's keep that as focal point.

Please find attached a copy of the form that each of us will need to use for emergency adoption of our respective revised codes. If anyone has started this, it would be good to share. If not, I am willing to work with our code liaison person here to get things rolling.

Good morning, Sue and Joe

I talked to Bruce Marvin yesterday and we talked about a couple of options for model conduct code revision. One was tossing the current sexual misconduct section and replacing with new Title IX procedures. The other option is to keep the section currently in the code and add the new Title IX procedures as supplemental (to cover the narrower definition that has come down through Ed. Dept.).

Bruce also thinks there may not be a heavy lift to update the 2017 code. He is expecting a ruling on academic misconduct (a significant ruling) to be handed down in the very near future. That is probably the most substantive piece to update in the overall code. He also mentioned some work around definitions (specifically, sexual harassment) that needs to be done.

He is going to be gone for a couple of weeks and was reaching out to Dave Stolier yesterday on additional help for us and our work. He suggested I work with my AAG, and I think we can do that and get things moving.

I want to get some common language for the emergency action (what we need for form 103e) for all of us.

I would like to have a few minutes at our meeting Thursday morning at 8 to discuss with the entire group. I planning to lay out the options with a strong suggestion to keep the current and add Title IX as supplemental.

I am copying those that expressed an interest in being on the work group to update the code so they can each be thinking about this.

The model 2017 code policy and procedures are attached.

Hi Joe,

I am talking to Bruce Marvin tomorrow afternoon to come up with our plan of attack. We have our supplemental section on sexual misconduct that needs to be updated with the final rule (or at least ready to go depending on what happens with the injunction), and there is interest in reviewing/updating the overall code which is in addition to the Title IX component.

All that said, there is overlap and a need for us to be sure we are not duplicating effort as Michele states.
