Julie,

The office is still digesting the contents of this morning’s decision.  The court appears to identify some concessions by DOE that may be useful when OCR actually begins enforcing the rule.  At this point in time, however, I think it is sufficient to simply let commission members know that the court denied the motion to enjoin implementation of the rule and, therefore, the colleges should proceed with their plans to adopt new policies and procedures that will take effect on the August 14, 2020 implementation date.

A copy of the multi-state ruling is attached.  This is the case in which the State of Washington was a plaintiff.

One of my colleagues just informed me that OCR has issued guidance indicating that the new Title IX rule will not be retroactive.  This means that it will only apply to alleged sexual harassment incidents that occur on or after August 14, 2020.  A link to the OCR webpage is attached.
