Julie and Joe,

I spoke too soon.  We received clarification last week that a Federal District Court in Massachusetts has vacated<https://nwlc.org/wp-content/uploads/2021/08/8.10.21-Order.pdf> the Title IX regulation provision that prohibits the admission of hearsay evidence without cross-examination.  This simplifies Title IX hearings significantly and is a change that Colleges will want to address immediately.  Although the federal rule has been vacated, CTCs will also want to revise their Title IX procedures accordingly as hearing procedures adopted locally in compliance with the vacated rule may still be enforceable.

All this to say that I will be sending out revised versions of the Model Procedures later this week that reflect this change.
