Subject: COVID-19 Update for April 3, 2020

The information listed below has come-up since yesterday's message was sent.  It will be shared with the WACTC Commissions.  Additional information/details may be accessed through our Google Drive at https://drive.google.com/drive/folders/1PnHhItWpvNhUhhxrCq5LSzxjenmVS5nw

*       General Information:

  *   During Governor Inslee's April 2 press conference, he extended the terms of the Stay Home - Stay Healthy proclamation to 11:59pm of May 4, 2020 (making May 5th the first day back). He stated that this 4 weeks extension is needed to achieve the goals of saving lives and having more people stay healthy.  He shared a chart showing that, although Washington seems to be bending the curve, we are continuing to increases in the number of deaths and positive test results.  In answer to a question, a department of health official estimated that we should see the peak around April 11. (See Proclamation 20-25.1 at https://www.governor.wa.gov/sites/default/files/proclamations/20-25.1%20-%20COVID-19%20-%20Stay%20Home%2C%20Stay%20Healthy%20Exte)
  *   With the extension of the Stay Home - Stay Healthy order until May 5th, it appears that K-12 schools will remain closed at least through that date.
  *   OFM Director, David Schumacher, issued a notice to agency and institution heads this afternoon, warning of supplemental budget vetoes and difficult choices in the near future.  He noted that when the Legislature adjourned three weeks ago, the state was projected to have nearly $3 billion in total reserves at the end of the biennium.  But the state's fiscal outlook has deteriorated dramatically since then.   He urged agencies and institutions to begin planning now for the likelihood that OFM will soon be asking for savings and reduction options to consider for the 2021-23 biennial budget.
  *   The AAG's office has offered guidelines for MOUs when colleges are providing facilities, resources, equipment to other entities.  They are also developing some templates for different scenarios-use of equipment versus use of a building.  Although these are "works in progress," some AAGs are using initial drafts to assist colleges that are facing these requests now. The full guidance has been posted on the Google Drive in the "General guidance and resources" folder.
  *   State Board staff will work with Dr. Hillary Godwin, UW Dean for Public Health, on a return visit with WACTC, potentially during one of WACTC's 8am Zoom meetings.  Staff will work with her to identify the optimal time for her to share expectations for the future.  Once date/time has been set, WACTC members will be asked to prepare questions.

*       Capital and Operating Budget
o   Daily Cash Deposits.  An OFM memo was forwarded to BAC and BAR members earlier today. It waives the requirement of making daily deposits of cash receipts, citing the Governor's "Stay Home - Stay Healthy" order and that many financial institutions have decreased the availability of branch banking services. This exception is granted to all state agencies utilizing local bank accounts, and continues until the Governor lifts the "Stay Home - Stay Healthy" order.
o   Capital Construction - On April 2, the Governor issued Proclamation 20-40, delaying implementation of various building codes. Projects currently in design that were planning to submit for permit review under current codes before July 1st now have until November 1st. Colleges with projects scheduled to submit for permit review under the new codes between July 1st and November 1st should work with their DES project manager to determine the best plan forward. o   Disaster Response Account funding.  Established with the $200 million appropriated by the State Legislature, funds are available for expenses required for the COVID-19 response, but will result in the agency overspending its appropriation.  In yesterday's Update, we noted that it was our understanding that most of these funds were already spent or committed. *       Instruction/ Student Services
o   Extending the Stay Home - Stay Health order to May 4 creates a number of challenges for colleges' hand-on, equipment intensive programs.
?  We continue to work with higher education partners, the Governor's Office and the Nursing Commission to get clarity and additional flexibility that provides the ability to move nursing and other allied health students through programs, graduation and into the field.
o   While clearly interested in not slowing down health care worker production, the Stay Home - Stay Healthy order does not clearly  provide an exemption for health care faculty and students.  We received verbal assurance late this afternoon that nursing faculty and students are deemed "essential" by the Governor's Office.  Staff is partnering with other higher education representative on a draft executive order.  Given that some nursing programs are scheduled to begin spring quarter on Monday, an e-mail was sent by Jan Yoshiwara to Presidents informing them that nursing faculty can engage with nursing students in labs with social distancing during the extended Stay Home - Stay Healthy period.
?  While the Nursing Commission has provided additional flexibility in use of sim-labs, requiring all nursing programs to individually complete and file exception applications, creates additional work and uncertainty that is delaying or keeping colleges from starting related spring quarter classes.  If a program is in good standing with the Commission, it should be allowed to rely on sim-training as clinical experience is not available at this time.
?  A list of health care programs is being developed that could be included in any Governor's Office clarification or an additional proclamation.
?  Consistent messaging and practices across the system would be helpful.
o   Dropping Student for Non-Payment. The CARE Act provides funding for direct student support, including tuition payments (as long as they are not supplanting state funds, including financial aid). Concern was expressed about the possible gap between when tuition payments are due and when the CARE Act funds are provided to the college.
?  Tuition payment deadlines vary by college, anywhere from two weeks to one day prior to a quarter start date, then at the time of registration.  The State Board has adopted the following drop policy:

5.40.40 Students Reportable for Enrollment



Students who register for a class prior to the census date and do not subsequently drop prior to the census date count for enrollment reporting. Note: Students who have not paid, waived, have a payment plan established, or a guarantee from a third-party payer (L&I, DVR, VA, state or federal aid, or similar) for tuition and/or fees by the census date are not reportable for enrollment reporting. An exception to this is a student, including but not limited to registered apprentices, who attends a class prior to the census date and registers prior to the completion of the class, may count for enrollment reporting if special provisions for post census date registrations as defined in Policy Manual 5.60.10 have been followed.



As highlighted above, and mentioned during the WACTC conversation, students with a payment plan or a guarantee from a third-party payer are counted and do not needed to be dropped for non-payment.  CARE Act funds fit into that third-party payer category. Colleges may want to review/revise local policies.
?  A related question:  "Could a college foundation make the tuition payment for the student and be reimbursed from CARE Act funds when they arrive?"  Given the ability to maintain the student's enrollment through the policy copied above (third-party guarantee), this would be an unnecessary and complicated step that may raise audit/accountability questions.
o   Questions have been asked about students accessing college computer labs and internet during the extended Stay Home - Stay Healthy order.  Concern was expressed regarding equity issues for students who cannot afford the IT or internet access or who live in rural areas and have no internet access.
?  It was understood that the Stay Home-Stay Healthy order will keep colleges from opening their computer labs for student use through at least May 5.
?  Colleges are distributing laptop and hotspots but anticipate not having enough to meet the need.  Equipment is on back order.  Several colleges reported estimates that 30% of students do not have the IT access needed to take courses on-line.
o   Ideas were shared on Childcare Centers and distributing food to students in need:
?  Some colleges are closing their childcare centers others are trying to keep them open for the children of first responders, health care and other essential workers - doing the best they can with social distancing and preventative sanitation measures.
?  Some college are adopting foodbank and K-12 food delivery practices of:
*       Asking students in need to call or e-mail their food needs to the college food pantry
*       Collecting and boxing up those items
*       Having the student drive to the campus. Box is provided without the student having to get out of the car.

*      Issues being worked:
o   A variety of questions related to CARE Act funding amounts, use, timing, use of funding provided to the Governor, use of funding for "Dreamers," accountability for expenditures, etc.
o   The ability to order equipment but not get delivery until after the start of the new fiscal year is being explored. Much of this equipment is on backorder, delayed or needed due to COVID-19.  Includes equipment like laptops, hotspots, sim-lab equipment.
o   Follow-up with Senator Murray's office regarding possible college participation in the production of Personal Protective Devices.
o   Correctional Education. State Board staff is working with DOC leadership to gain clarity on need for faculty to be in correctional facilities - especially with extension of the Stay Home - Stay Healthy order.
o   Apprenticeship.

*      Event Cancellations/Changes (Newly Added/Updated in RED)

     *   Dual Credit Summit, March 16-17 cancelled and being rescheduled for fall 2020 (Looking at October 5/6, 2020)
     *   ATL Retreat, March 26-27, cancelled.
     *   Dean Community of Practice, March session cancelled.
     *   Bridge to College meetings have been converted to virtual convenings.
     *   Guided Pathway Work Plan review, March 12-13, is converting to an online modality (details to follow).
     *   Annual Students of Color conference April 23-25 Yakima cancelled
     *   All Student Services conference April 29-May 1 Tacoma, Student Services Commission has been re-scheduled to May 3-6, 2021.
     *   Team Teacher training at Centralia College, March13, 2020, Cancelled
