Hi PIOs,

Here are some good things to know as you respond to President Trump’s threat to deport “millions” of undocumented immigrants next week.


·       Attorney General Bob Ferguson published a helpful booklet on how to protect students’ rights and appropriately respond to federal immigration authorities<http://agportal-s3bucket.s3.amazonaws.com/uploadedfiles/Another/AGO%20Immigration%20Guidance.pdf>. Part VI addresses K-12 and higher ed.

·       In 2016, our attorney general for SBCTC, David Stolier, gave then executive director Marty Brown guidance on appropriate messages to tell students about college responses to ICE. You’ll find those points in his email (attached) and the sample letter below.

·       The University of California created a statement of principles<http://undoc.universityofcalifornia.edu/files/uc-principles-in-support-of-undocumented-members-of-the-uc-community.pdf> in support of undocumented students. Much of it deals with policies affecting campus police (which of course we don’t have), but there’s good language overall.

·       This resolution from the Board of Education for Portland Public Schools<https://www.pps.net/cms/lib8/OR01913224/Centricity/Domain/219/Immigration%20Resolution%203%20FINAL.pdf> also has some good messaging, but David Stolier advises us that items #1 and #2 are pretty much unenforceable.

·       ICE has said that colleges are “sensitive locations”<https://www.ice.gov/ero/enforcement/sensitive-loc> that should be avoided by agents unless their supervisors give them prior approval. That said, according to the Bipartisan Policy Center, the “sensitive locations” policy is largely symbolic<https://bipartisanpolicy.org/blog/immigration-enforcement-and-sensitive-locations-where-can-ice-make-arrests/>. For example, ICE can take enforcement in sensitive locations under urgent circumstances, or if other law enforcement officers bring officers to the location (hence, some of the language in the University of California resolution above), or if the officers get prior approval.

Sample email to students

Earlier this week, President Trump threatened the mass deportation of undocumented immigrants. This deeply troubling announcement strikes at the very heart of our mission as a community/technical college  – to serve as an open-door institution where all students can achieve their educational dreams, regardless of documentation. With this in mind, we would like to reaffirm our current practice in serving undocumented students:


  *   The college has no legal obligation or affirmative duty to enforce federal immigration law. Accordingly, we do not provide information to others without a lawfully issued subpoena or court order.
  *   College security officers do not question people about their immigration status and do not detain persons because they are undocumented.
  *   We do not request immigration documentation except as needed to determine eligibility for resident tuition rates.
  *   We do not make admission decisions based on immigration status, and we do not request immigration documentation except as needed to determine eligibility for resident tuition.
  *   Consistent with the Family Educational Rights and Privacy Act (FERPA), the college will not release protected student information without a lawfully issued subpoena or court order.

We realize that President Trump’s announcement is causing fear and anxiety on our campus. [If you have counseling resources or other resources available, list them here.)

We remain committed to providing  a safe, civil, inclusive, and supportive environment for each and every student who comes through our doors in search of new opportunities and a bright future. You are a member of our campus community and you are welcome here.
