It's possible that this student believes they fall under the Jay Treaty. The Q&A document on the wiki has a question about this as follows:

45. Question: Is a student living in Canada who holds a Certificate of Indian Status issued by the Indigenous and Northern Affairs of Canada eligible for resident tuition?

Answer: This student falls under the Jay Treaty, which means that WA cannot deny resident tuition to the student because of their Canadian citizenship. It does not by itself qualify any student for resident tuition. The student still needs to qualify for residency under RCW 28B.15.012(2). Because this student does not live in WA or any other qualifying state in RCW 28B.15.0131 (ID, OR, MT), they are likely not eligible.

So, in this student's case, they would need to show you a "Certificate of Indian Status" from Canada and then they'd have to meet our residency laws. If the student is financially dependent and his parents live in Canada, he could not get residency. If he is financially independent, he could only get it after having domicile in WA for one year.

The best website I can find about this benefit is here: https://ca.usembassy.gov/visas/first-nations-and-native-americans/. Essentially, they say that the person must have been born in Canada and have evidence of at least 50% "American Indian" status (this term appears to include both members of Canadian Bands and US Tribes). From what I understand, the Certificate is only given to those who meet this requirement.

If anyone has dealt with a student in this situation, please chime in.

Good Afternoon,

We have a student who is a citizen of Canada, has just moved to Bellingham, WA and is indicating they're affiliated with the Native American Nuxalk and Heiltsuk Bands.

They're asking for in-state tuition; however, after reviewing the residency handbook on pages 36 and appendix B-7 it doesn't look like they qualify.

Page 36 says they need to meet two items, domicile in one of four states and be in one of the federally recognized Indian tribes in appendix B-7.

Based on this, would they ever qualify, as they're here as a temporary resident per their admissions and are not a citizen?

Please let me know if I'm missing something.
