<p class="MsoNormal"><b>Answer:</b> This student falls under the Jay Treaty, which means that WA cannot deny resident tuition to the student because of their Canadian citizenship. It does not by itself qualify any student for resident tuition. The student still
needs to qualify for residency under RCW 28B.15.012(2). Because this student does not live in WA or any other qualifying state in RCW 28B.15.0131 (ID, OR, MT), they are likely not eligible.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">So, in this student’s case, they would need to show you a “Certificate of Indian Status” from Canada and then they’d have to meet our residency laws. If the student is financially dependent and his parents live in Canada, he could not get
residency. If he is financially independent, he could only get it after having domicile in WA for one year.<o:p></o:p></p>
