Hi Stacy,

Do you mean she is trying to establish residency? Students with an H4 are eligible for resident tuition.

As long as she has lived in WA for one year primarily for purposes other than educational (preseumption), she does not need a domicile, nor does either of her parents, and she doesn't have to be independent or dependent--reference RCW 28B.15.012(2)(f).<https://app.leg.wa.gov/rcw/default.aspx?cite=28b.15.012>

(f) Any person who has lived in Washington, primarily for purposes other than postsecondary education, for at least one year immediately before the date on which the person has enrolled in an institution and who holds lawful nonimmigrant status pursuant to 8 U.S.C. (a)(15) (E)(iii), (H)(i), or (L),<https://www.govinfo.gov/content/pkg/USCODE-2021-title8/html/USCODE-2021-title8-chap12-subchapII-partIV-sec1227.htm> or who holds lawful nonimmigrant status as the spouse or child of a person having nonimmigrant status under one of those subsections, or who, holding or having previously held such lawful nonimmigrant status as a principal or derivative, has filed an application for adjustment of status pursuant to 8 U.S.C. Sec. 1255(a);

This is my thorn in my side, and knowing me I am overthinking this. I am working with a student who is on a H4 visa and she is trying to establish citizenship. Can someone on a H4 establish citizenship? What questions should I be asking the student.
