We set up a shared email (copyright at evergreen.edu<mailto:copyright at evergreen.edu>) for this and use this as "designated agent" info:

Copyright Officer
The Evergreen State College
2700 Evergreen Parkway NW
Mailstop: LIB 2300 | Attn: Ahniwa Ferrari
Olympia, WA 98505
Phone: 360-867-6288
Email: copyright at evergreen.edu<mailto:copyright at evergreen.edu>

Because, yes, many of these are DMCA or "get your students to stop pirating things" that are better served going to our IT folks then me.

Probably 95% of the notices you will receive through this tool will be because people are downloading / torrenting materials via the campus network.

I'd talk to your local IT folks about what the appropriate response is when those notices do come in. I can talk about what we do, but I think it will differ from school to school.

Best,
Ahniwa D. Ferrari (he/him)

All:

I am including an excerpt of an email thread below concerning Bellevue College and KBCS with regards to registering for DMCA. Per BC Policy 3600<https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.bellevuecollege.edu%2Fpolicies%2Fid-3600%2F&data=04%7C01%7Cferraria%40evergreen.edu%7C2f2dcb1c1e2c4d28844a08d89ba0dda7%7C22adcff7c06f49a68f2050711c40ddaa%7C0%7C0%7C637430462528502282%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=jjDnybdeGp0bvUAGiutEvR5HzqFO8P%2BHUElrnW8qvR4%3D&reserved=0>, the chief administrator of the library is the copyright officer (this is me, at present).

Does anyone else serve as copyright officers for their campuses? What does this entail? My chief concern here is I am an expert on copyright, but not a lawyer. In this scenario, I think I would serve as the first stop for takedown notices and copyright infringement issues.

Thank you in advance for your input and feedback on this.

Take care.

"If you allow others to post comments, images, or other material anywhere on your station's website, then you should read this reminder.

You may need to renew your Designation of Copyright Agent online with the Copyright Office. This online registration is required in order to qualify for the safe harbor under the Digital Millennium Copyright Act ("DMCA"), which protects qualifying internet service providers from claims of third party copyright infringement if they timely register and follow certain steps upon receiving notice of a claimed infringement. To register or to get more information, visit https://www.copyright.gov/dmca-directory/<https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fwww.copyright.gov%2Fdmca-directory%2F&data=04%7C01%7Cferraria%40evergreen.edu%7C2f2dcb1c1e2c4d28844a08d89ba0dda7%7C22adcff7c06f49a68f2050711c40ddaa%7C0%7C0%7C637430462528502282%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=IYuHzxMbJEckCeArCR%2BJukTY8UTrzVmUW%2BR8l3sVIcE%3D&reserved=0>.

If you re-registered online on or after January 1, 2018, or last year, the registration should be valid for three years, but any "paper" registration filed before January 1, 2018 is not valid anymore. If your registration expires this year, you have until December 29, 2020, to re-register.

It will only take a moment to check to see if your DMCA copyright agent designation expires this year or has lapsed. If you are not in the online database, then you should register online ASAP. Here's a link to search the Copyright Office database to confirm whether or not your Designation is duly registered: https://dmca.copyright.gov/osp/<https://nam02.safelinks.protection.outlook.com/?url=https%3A%2F%2Fdmca.copyright.gov%2Fosp%2F&data=04%7C01%7Cferraria%40evergreen.edu%7C2f2dcb1c1e2c4d28844a08d89ba0dda7%7C22adcff7c06f49a68f2050711c40ddaa%7C0%7C0%7C637430462528512244%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C1000&sdata=ZtuakpQLQ2e2jysRZb9bGrhqhAMq3jyi3Ljwl%2BxBDFc%3D&reserved=0>

You must also keep the copyright agent designation current, meaning that you must re-file if you change the agent, or the registered contact information changes. Changing the designated agent or other amendments to the registration starts the three-year period anew.

In addition to filing online with the Copyright Office, to qualify for the safe harbor, you need to post on your website your copyright agent contact info in case anyone needs to send you a takedown notice. Specific steps needed to qualify for the safe harbor protection are explained in the attached "DMCA Agents" and "Notice and Takedowns" memo.

Please contact me or any of the lawyers listed in the attached Notice and Takedowns Memo if you have any questions or need any help with DMCA matters."
