Subject: COVID-19 Update for June3, 2020

These updates are sent on Wednesdays and Fridays, to better align with the WACTC calls on those days.  If you have questions, however, please feel free to call John Boesenberg or any other State Board staff member who could best respond.

*       General Information

  *   On May 29th, Governor Inslee extended a number of proclamations, including exceptions to the Open Public Meetings Act.  Essentially, the changes continue to provide for governing agency and institution bodies to meet remotely.  Through June 17, 2020, college trustees are:

     *   Allowed to continue meeting remotely.
     *   Allowed to require members of the public who'd like to participate to identify themselves so that remote participation can be provided.
     *   Not required to post notice of the change of a scheduled regular meeting (i.e., from in-person to remote meeting) in the state register at least 20 days prior to the meeting.
     *   Not required to post notice of a special meeting at the main campus entrance or the entrance of an off-campus meeting site.
     *   Not required to post notice of adjournment on or near the meeting room door when any meeting is adjourned to a time and place specified in the order of adjournment.  (Notice of the adjournment to another time is still required to be posted, assumedly on the college's website.)

At this time, it is difficult to say what will happen after this extension expires on June 17, 2020:
?  The Governor, with agreement from the leadership in the Legislature, may extend the exceptions noted above for an additional time period, maybe at least until counties are approved to move into Phase 3 (which allows for gathering of up to 50 people).
?  Governing bodies may be required to meet the requirements of the Open Public Meetings Act, without the exceptions summarized above.  Colleges, and other governing bodies (i.e., school boards, port commissions, county councils, etc.) cannot except themselves from the Acts requirements.  For "regular meetings" this would be challenging and require additional planning to ensure notification timelines were met.  If unable to meet the "regular meeting" requirements, colleges would likely apply the "Special Meeting" requirements as delineated in RCW 42.30.080<https://app.leg.wa.gov/RCW/default.aspx?cite=42.30.080>.



  *   The Association of Washington Business has a webpage to help employers find PPE. The webpage can be used by any employer, including colleges.  Just enter the area code and desired PPE and the webpage will connect you with suppliers in your area.  The link is:  https://www.reboundandrecovery.org/ppe-connect/.


  *   Zoom has agreed to continue its provision of free licenses for its product through September 20, 2020.  It is believed that by that time agreement will have been reached to include CTCs in the K-20 contract pricing.

*       Operating and Capital Budget

  *   Additional clarification is being sought on appropriate costs that can be reimbursed through the CARES Act institution funds.  The discussion is focusing on the whether or not COVID-19 caused decreases in tuition collections can be considered a cost that can be reimbursed using these funds.  The answer appears to be "it depends."  Essentially, the challenge is documenting the relationship between the decrease in tuition collections and COVID-19.  While it is much easier to document the cost of, for example, a laptop provided for students to access on-line courses, it is more challenging to document the nexus between declining tuition collections and COVID.

  *   The Eastern Washington University trustees are expected to vote on the crisis declaration at their June 25 meeting. Doing so would invoke a clause in the university's collective bargaining agreement with the United Faculty of Eastern, giving President Mary Cullinan broad latitude to reduce spending in all departments. Although the figures are subject to change, Mary Voves, EWU's vice president for business and finance told the trustee last Friday that  the university could lose more than $12 million in state funding and more than $24 million from tuition and other sources. That would result in a roughly 12.4% budget cut in the 2021 fiscal year, following two years of much smaller reductions that have involved layoffs and frustrated many faculty members. *       Instruction/Student Services
o   On Monday, June 1st, Governor Inslee issued higher education and workforce training requirements in Phase 1 and Phase 2. These guidelines do not apply generally to higher education institutions; they apply only to workforce training programs that require in-classroom/lab practicums only. Guidance documents:

o   Clarification was provided on the safety protocols required as colleges expand offerings of hand-on, equipment intensive labs.  Essentially, protocols for Phase 1 and Phase 2 are the same, allowing for some relaxation of the 6-foot social distancing requirement for labs approved to meet in-person for colleges located in Phase 1 or Phase 2 counties (Although maintaining 6ft social distancing is still preferred, it is no longer required.)
?  To further clarify, labs where the work requires proximity of less than 6ft can be offered but PPE must be used.
?  Colleges in counties that continue to be in Phase 1 are still limited to offer only those labs aligned with the Governor's essential business list.  (We're calling this Phase 1.5.)
?  Colleges in counties that have been moved into Phase 2 can expand lab. offerings to those meeting workforce pathways pre-requisites.
?  Dental Hygiene clinics are included in the revised protocols (less than 6ft social distancing).  However, within their plans, colleges must address how they will mitigate the safety risks (i.e., appropriate PPE and cleaning).

o   Several districts have developed COVID-19 related safety training and posted links on their websites so students and employees can take the program prior to coming on campus.  Seattle District is preparing a 10-minute video; LCC has a program on its website.

*       Issues being worked
o   Summer Running Start - Essentially, there is agreement on policies however, there continues to be discussion on funding.  State Board staff continues to work with OSPI to identify a funding source - potentially the Governor's or OSPI's K-12 CARES Act funding.
o   Spring quarter Running Start Reimbursements.  State Board staff are working closely with OSPI to determine the actual spring quarter running start enrollments (as opposed to projected enrollments).  OSPI is collecting enrollment data from school districts; State Board is surveying colleges for their Running Start data.  Once collected, this data will be compared and discussions on how to reimburse colleges using the actual, rather than projected data will continue.
o   Clarity is being sought for cleaning protocols applicable to Phases 3 and 4.

*       Upcoming Event Cancellations/Changes (Newly Added/Updates in RED)

     *   Workforce Connections Forum, scheduled for May 18-19th, has been rescheduled to August 25-26th.
     *   Rendezvous 2020, July 27-29 - Cancelled
     *   The WACTC Summer retreat will be entirely held through Zoom on July 27-28.
