Today we received proposed revisions to the higher education proclamation.  The two revisions address the issues that we raised.

Colleges are no longer required to collect attestations from unvaccinated students that they are not vaccinated.  That means colleges will collect vaccination information from students, faculty and staff who wish to verify that they are vaccinated to avoid wearing masks on campus parallel to what employers are required to collect from employees.

Second, the requirement to identify alternative arrangements for employees who refuse to work on campus due to safety concerns has been changed to align with a new state law passed last session focusing accommodations on employees with health risks (Engrossed Substitute Senate Bill (ESSB) 5115), the Health Emergency Labor Standards Act (HELSA).  The law went into effect on May 11, 2021.  HELSA works in conjunction with the Americans with Disabilities Act (ADA) and the Washington Law Against Discrimination (WLAD).  Under HELSA the employee must obtain a recommendation from their medical provider affirming they are high risk and must be removed from the workplace.  The employee is not required to disclose any medical conditions or diagnosis to their employer. After checking in with a number of people involved, I decided to give it one more shot at changing two provisions in the higher education proclamation for non-vaccinated campuses that we have discussed.

The first provision is to collect a statement from unvaccinated students that they are not vaccinated.  I have a hard time seeing what would motivate an unvaccinated student to submit such a statement.  They would still have to wear a mask on campus.  The concern seems to be having the information for contact tracing so it is important that you all continue to implement your contact tracing plans if we can get this requirement removed.  Second is the provision to identify alternative work arrangements for employees who refuse to work on campus.  We worked with Dave Stolier, head of the education division for the Attorney General’s office, who believes that language is unnecessary and covered by ADA requirements for people with health risks.

I had a good discussion with the governor’s chief of staff, and sent her edits on those two provisions along with reiterating some points on why they would be difficult to administer and counterproductive to student success.  I got clarification on two items:

·       The requirement to collect vaccination information from all students means all students attending classes in person on campuses, and does not apply to students who are in online classes only.

·       The effective date of July 1 is intended for vaccinated campuses.  The new requirements for non-vaccinated campuses to collect vaccination information from students is intended for Fall quarter.

The poll from last Wednesday’s call showed that six of you have decided to mandate vaccinations, 13 of you have decided not to require vaccinations and about half of you had not decided yet, mostly because you had not seen the final proclamation.  Julie Walter and I spoke to Christine Johnson and Chris Bailey on Friday about the value of holding a longer Wednesday morning call next week for you to share implementation strategies with each other, both as vaccinated campuses and non-vaccinated campuses.  I will update you on the changes to the proclamation by email so that the WACTC discussion can focus on implementation.  Julie will send you a meeting invitation and zoom link for next Weds, July 14, 8-9:30am.

Below is the press announcement about the revised higher education proclamation including a link to the full proclamation.

Several items that we requested are reflected in the proclamation.

·       Faculty and staff may provide vaccination information if they wish to avoid wearing a mask on campus, parallel to LNI requirements of all employers.

·       Student self attestation that they have been vaccinated is added to the forms of evidence of vaccination, although additional detail has been added about what has to be included in the self attestation.

·       Higher education specific masking enforcement language has been removed.

·       Cafeteria patrons can pay in cash.

Two requests are not reflected in the proclamation:

·       Non-vaccinated campuses still have to collect vaccination information from all students including those who are not vaccinated.

·       The language that colleges “identify available alternative arrangements for student workers and personnel upon requests or refusals to work due to concerns related to campus safety” was included.

We will pursue the following steps tomorrow.

·       Connect with senior staff in the governor’s office who approved this proclamation today on the vaccination collection requirement for non-vaccinated campuses.  This language seems very difficult to actually implement.

·       Work with AAG Dave Stolier for interpretation of the “alternative arrangements” language.  This is existing not new language and a refresher on how it is to be implemented would be helpful.

·       We may wish to have a discussion among you about implementation strategies.  I will work with WACTC leadership.

Since this was released as a press release, it went out to the media.  I’m asking Laura to develop talking points to assist you in case you are contacted by local media.
