  *   On Tuesday, May 12, Governor Inslee made several announcements and issued guidance on the resumption of in-store retail and manufacturing operations.
§  Three proclamations were extended through agreement with Legislative leadership. This means that the 5-day response requirement continues for requests received electronically by an agency.)

§  Statewide contact tracing plan was shared that will allow more businesses to open and more people to be active in public while helping to slow and prevent the spread of COVID-19. ·       The Governor stated that contact tracing will allow us to get a better handle on who gets sick and how the virus is spread, which is vital to re-opening our economy.
·       Local health departments will lead these efforts and the state Department of Health and its partners will support this work.
·       The information collected is only used by public health professionals and is confidential. It will not be shared. Contacts will not be told the name of the person who may have exposed them to COVID-19.

o   Partially resuming limited in-store retail and manufacturing operations for counties granted variance under the Safe Start Phase 2 recovery plan laid out last week<https://medium.com/wagovernor/inslee-signs-new-covid-19-order-for-phased-re-opening-of-washingtons-economy-ad5ea919ab56?utm_medium=email&utm_source=govdelivery>. Through the Washington "Safe Start<https://www.governor.wa.gov/sites/default/files/SafeStartWA_4May20_1pm.pdf?utm_medium=email&utm_source=govdelivery>" plan, more businesses and activities will re-open in subsequent phases with adequate safety and health standards in place. Each phase will be at least three weeks - metrics and data will guide when the state can move from one phase to another.  Counties with a population of less than 75,000 that have not had a new case of COVID-19 in the past three weeks can apply for a variance to move to Phase 2. County variance applications will be approved or denied by the secretary of the Department of Health. Eight counties have received the variance.

For counties granted variance to move to Phase 2, in-store retail operations may resume with limitations, effective May 12.   *   Inside Higher Ed reports that the Department of Education ignored the intent of the CARES Act to give local colleges discretion to aid students most affected by the pandemic, and instead has arbitrarily excluded as many as 800,000 community college students," Oakley said in a statement. "Among those harmed are veterans, citizens who have not completed a federal financial aid application and non-citizens, including those with DACA status."   *   As colleges continue to plan for fall quarter, questions related to testing and contact tracing protocols are being asked
     *   How are we planning for testing?  Will colleges be asked/required to perform testing on employees/students?
     *   Who will be responsible for contact tracing?  If colleges are responsible, what does that look like?
     *   What are the risks involved in these activities?
These issues are being discussed as part of the higher education discussions that include group public/private universities, private career schools, CTCs.  It was noted that CTCs are not equipped to perform testing.  However, an online contact tracing continuing education training program is being developed by LWTech.  This training takes about 5 hours and, for system participants, would be limited to contract tracing on campus, not in the broader community.

·      Operating and Capital Budget
o   OFM issued a memo addressed to Executive and Small-Cabinet agencies directing them to freeze hiring, personal service contracts and equipment purchases.  A number of exceptions to the freeze were listed and the memo described an exception request process.  Higher education institutions and other agencies not covered by the directive were encouraged to take similar actions.


·      Employment
o   State collective bargaining agreements:  Governor Inslee issued a proclamation on Friday, May 8th, that waives/suspends statutes related to the funding process for certain collective bargaining agreements.  It is effective through June 2, 2020 and designed to provide relief to some of the additional costs of employment due to COVID-19. This action enables OFM to use federal funding to address increased COVID-related costs for certain represented employees. Current law may require that funding not be provided until after the next legislative session, however the increased costs and need for funding exists now. In addition, if current law is not temporarily waived, the federal funding sources might not be available after the next legislative session. This waiver will not obligate the state for future costs and is time limited. §  This proclamation potentially affects the funding of the civil service classified bargaining agreements throughout state government, including those at the community colleges. Essentially, it appears that by suspending the statutory funding process governing civil service agreement funding, which includes ultimate approval by the Legislature, that federal funds could be used to support those agreements as costs have increased due to COVID-19.



o   Identify Theft/Unemployment Claims.  It's been reported that college HR offices are being inundated with fraudulent unemployment claims.  This is happening throughout state agencies and private employers. ESD has provided a detailed process of how to handle.
ESD instructions
Call or email ESD (800-246-9763/esdfraud at esd.wa.gov<mailto:800-246-9763/esdfraud at esd.wa.gov>) and let them know a fraudulent claim has been filed.  ESD will send a questionnaire to complete and return with a copy of the employee's driver's license.  Once the call or email is recorded, the claim is immediately closed and no payouts will happen. They will also conduct an investigation and once that is completed, transfer the fraudulent claim out of that person's SSN.


·       Instruction/Student Services
o   On May 6th, the Department of Education issued guidance for reporting CARES Act student grant information.  It indicated that the Department will provide instructions for providing the required information to the Secretary in the near future. In the meantime, DOE is requiring each participating institution to post the specific information on the institution's primary website. ·      Issues being worked


o   State Board staff will clarify safety protocols for classes currently allowed to meet on campus.  Specifically, must social distancing be maintained for classes in the allied health and vet. tech programs; or can additional PPE be used to address lab situations where 6 feet between folks cannot be maintained?


o   State Board staff will survey colleges to get an  update on fall quarter plans.


o   Summer Running Start - Essentially, there is agreement on policies however, there continues to be discussion on funding.  State Board staff continues to work with OSPI and will provide an update on Friday's WACTC call.


o   Re-opening of Dental Hygiene programs and clinics.  May 18th is the date identified by the Governor as the date dental offices may re-open.  It is unclear if that date is still his intended re-opening date and how that affects dental programs and clinics operated by our colleges.


·      Upcoming Event Cancellations/Changes (Newly Added/Updated in RED)

     *   Faculty of Color Mentorship Program spring retreat (May 15) has been cancelled.
     *   Workforce Connections Forum, scheduled for May 18-19th, has been rescheduled to August 25-26th.
     *   Spring CEDD Corrections Education Deans and Directors quarterly meeting is moved to a virtual meeting on Zoom  It starts at 9:00 AM  to 4:00 PM on May 19, 2020 and 9:00 AM - Noon on May 20, 2020.
     *   PIC has changed its meeting from May 14 and 15 at Lake Washington to May 14 via Zoom.
     *   Rendezvous 2020, July 27-29 - Cancelled
     *   Information Technology Commission has shifted from May 14-15 at Clark to May 14 via Zoom
