*       General Information:

  *   Governor Inslee has scheduled a news conference for 5pm. today, April 21st.  It's anticipated that he will share his plans for the state's re-opening and recovery.


  *   Dr. Hilary Godwin, dean for the school of public health at the UW, made her second presentation to college presidents on Friday. She discussed COVID-19 projections modeling, key data used for projections and COVID scenarios for summer, fall and into the next academic year.
?  Starting with an overview of the current situation, Dr. Godwin shared data from  http://covid19.healthdata.org/united-states-of-america/washington.  This site provides COVID-19 projections for countries and each of the 50 United States.
?  She also touched on the President's phased approach for re-starting the economy (see https://www.whitehouse.gov/wp-content/uploads/2020/04/Guidelines-for-Opening-Up-America-Again.pdf).  Dr. Godwin contrasted public health concerns vs. economic concerns, indicating that a balance is needed.
?  As we move forward into a "new normal," Dr. Godwin indicated that it's likely that a phased approach, will be applied - that some restrictions will be lifted, followed by a pause to gauge impact.  Based on the data, the restrictions may be dialed up or dialed back.
?  She also discussed some considerations/process needing to be in place prior to re-opening: continued decline in cases, for at least two weeks, robust testing and contact tracing.
?  In response to a question, Dr. Godwin shared UW's plans for continuing on-line instruction for the first summer session and that a decision has not yet been made about the second summer session. Her expectations for fall quarter is that social distancing at some level will still be required, affecting larger classes at UW, and that the number of students from other states and countries will likely decline due to uncertainty and unevenness of the COVID-19 recovery.

*       Operating and Capital Budgets

  *   DOE Secretary, Betsy DeVos held a briefing this afternoon on the Higher Education Emergency Relief Fund-Institutional Portion (HEERF).  You can review the press release at https://www.ed.gov/news/press-releases/secretary-devos-delivers-6-billion-additional-grant-funding-support-continued-education-americas-colleges-universities.  The process for accessing these funds is similar to the process used to access the student targeted funds.  Please note that institutions must complete and submit the Certification and Agreement Student's Portion before submitting the CARES HEERF Certification and Agreement for the Institutional allocation.
     *   The Institutional portion is intended to cover any costs associated with significant changes to the delivery of instruction due to the coronavirus.  The funds can be used, but are not required, to provide additional emergency financial aid grants to students.  Institutions can choose how to allocate and use the funds, provided that funds will be spent only on those costs for which college has a reasoned basis for concluding they have a  nexus to significant changes to the delivery of instruction due to the coronavirus. The funds may be used to reimburse the college for costs related to refunds made to students for housing, food, or other services that the college could no longer provide, or for hardware, software, or internet connectivity.  Recipients have one year from submittal of the Certification of Agreement to spend the funds.  Regular reporting on expenditures are required.

*       Employment

  *   Tenure Review Committees at several colleges have expressed concerns regarding the impact COVID-19 and the Stay Home, Stay Healthy order has had on their ability to evaluate and support probationary faculty - asking if colleges can "ignore" spring quarter and extend the tenure process.  If they can, who makes that decision - trustees, presidents or review committees?



The short answer is that colleges cannot "ignore" spring quarter 2020 and automatically extend a probationary period by an additional quarter.  However, state law (https://app.leg.wa.gov/RCW/default.aspx?cite=28B.50.852)  provides trustees the authority to extend a faculty member's probationary period upon
?  Receipt of a formal recommendation from a review committee,
?  Receipt of the written consent of the probationary faculty,
?  The Review Committee member's  belief that the probationer needs additional time to satisfactorily complete an already-in-progress professional improvement plan.
The extension can be 1-3 quarters in duration. Local polices/negotiated agreements should also be reviewed and may require changes.  Even if the faculty union agreed, statutory provisions cannot be waived through bargaining.  It's advisable that colleges review each situation and plan such extensions at the beginning of the 3rd year of the tenure so that trustees can act prior to the end of the 8th quarter.

  *   The Employment Security Department developed the call center script below to help folks navigate through the UI system.  They also asked that this information be shared with employees.
     *   The Employment Security Department administers the Unemployment Insurance program.  While we can't help you file your unemployment claim, here are key tips for getting to the right place to file successfully and all of it can be found on ESD's website. Your best bet is to go to www.esd.wa.gov<http://www.esd.wa.gov> and take these steps:

1.      Stay up to date. If you haven't already, please sign up for ESD's COVID-19 action alerts. You can do so on the agency's COVID page (esd.wa.gov/newsroom/covid-19<http://www.esd.wa.gov/newsroom/covid-19>).

2.      Check your eligibility. Learn more about your eligibility and when to apply for benefits using the new eligibility checker<https://esdorchardstorage.blob.core.windows.net/esdwa/Default/ESDWAGOV/Unemployment/UIEligibilityChecker.pdf>. We are encouraging those eligible for regular unemployment to apply now, and newly eligible to wait until after April 18.

3.      Unemployment is expanding. The federal CARES Act allows self-employed people,<https://esd.wa.gov/unemployment/self-employed> part-time workers<https://esd.wa.gov/unemployment/cares-act>, and others affected by COVID-19<https://esd.wa.gov/unemployment/cares-act> to use unemployment benefits.      *   Keep in mind that the unemployment rates at the county level are not seasonally adjusted because the sample size is too small to accommodate that additional analysis. As a result, they should not be compared directly to the seasonally adjusted statewide rate.
     *   ESD has new labor market information and tools to showcase popular information and data.

*       Instruction/Student Services
o   The DOE updated its FAQ on the Student portion of the funds.  You can access that at https://www2.ed.gov/about/offices/list/ope/heerfstudentfaqs.pdf. The FAQs includes responses to questions that have been circulating in our system:
?  Clarifying the prohibition/limitation on institutions reimbursing themselves for their costs (1-4). Grants cannot be used to reimburse institutions for refunds given to students or for IT equipment or other items procured for student. Institutions may only reimburse themselves from the Student Emergency Grants share if they provided emergency grants given to eligible students as a result of disruptions on their education from COVID-19 on or after March 27, 2020.
?  The prohibition on institutions using of funds to pay outstanding/overdue student bills (5). Grants cannot be applied to outstanding balances or used to create scholarships for the next term.
?  Reporting requirements (6);
?  Clarifying the students eligible for funds (8, 9, 12).  Funds from either the Institutional share or the emergency grants to students can only be given to Title IV eligible students. These funds are also only available to students who were not exclusively enrolled in an online program at the time of the national emergency declaring on March 13, 2020.
?  How students can receive the funds (11, 5). Grants to students may not be applied to their institutional accounts, they must be provided to students directly using checks, electronic transfer payments, debit cards, and payment apps that adhere to the Department's requirements for paying credit balances to students.

*      Issues being worked (These items were included in the April 16th  Update)
o   Fees.  College collect student fees to pay for a variety of consumables and services utilized by students. Because each college has authority to collect student fees, the purpose and fee amount varies by district. The original intent for collecting some fees may have affected/repurposed as colleges transitioned to entirely/mostly remote instruction spring quarter. For example, chemistry lab fees, initially intended to pay for consumable lab chemicals may be repurposed to pay for consumable lab kits. The AG's Office has been asked to provide a list of considerations or principles colleges can use to evaluate their fees in light of the current situation.
o   State Board staff has worked with IC to identify Medical Assisting, Phlebotomy and Respiratory Therapy as allied health programs that, in addition to Nursing, are "essential" during this pandemic. The Governor's office is aware of this concern and conversations are continuing.
*      Event Cancellations/Changes (Newly Added/Updated in RED)

     *   Dual Credit Summit, March 16-17 cancelled and being rescheduled for fall 2020 (Looking at October 5/6, 2020)
     *   ATL Retreat, March 26-27, cancelled.
     *   Dean Community of Practice, March session cancelled.
     *   Bridge to College meetings have been converted to virtual convenings.
     *   Guided Pathway Work Plan review, March 12-13, is converting to an online modality (details to follow).
     *   Annual Students of Color conference April 23-25 Yakima cancelled
     *   All Student Services conference April 29-May 1 Tacoma, Student Services Commission has been re-scheduled to May 3-6, 2021.
