In case you haven't heard. It looks like we could have a delay in any new regulations for Distance Education and Return to Title IV.

Hello SAN Members!
The Federal regulation clock is ticking down for new final regulations for Distance Education and Return to Title IV to be released by November 1.
SAN and WCET are predicting that we will not see these new final regulations by November 1.  We believe that there is not enough time in these next two weeks to complete the required steps of the rulemaking process to meet the Master Calendar deadline required for Title IV regulations to be released by Nov 1 to be effective the following July.
Final Steps:

*        Release proposed rules - completed July 2024.

*        Provide public comment period - completed August 2024.

*        Submit draft regulations for Executive Branch Review<https://www.reginfo.gov/public/jsp/EO/eoDashboard.myjsp> (OMB/OIRA) - not completed.

*        Review by OIRA with 12866 Meetings<https://www.reginfo.gov/public/do/eoPackageMain> - not completed.

*        Regulations back to ED with OIRA comments for ED to develop the final version. - not completed

*        Release of final regulations by Nov 1, 2024, for July 1, 2025, effective date. - not completed.
As you see the final four bullets have not been completed.  Typically the OIRA review takes several weeks.  We were asked if ED could ask for the OIRA review to be expedited.  Perhaps it could but note the OIRA review is for all administrative agencies.  There are currently more than 140 regulatory actions under review by OIRA.
There could be many reasons why ED could choose to wait on the regulations. Rather than speculate as to why, we will share that we believe the next steps will be clearer after the election.  After the election, SAN and WCET will communicate with members with the information that we learn.  Please stay tuned!
