Hi Anneke,

A spouse's legal status does not qualify a student for resident tuition. If she meets the affidavit requirements, you can code her as IS. It doesn't sound like presumption is an issue.

Hi All:

We have a situation where a husband and wife both have H-1B visas. The wife is intending to enroll with us but her H-1B has expired and she has lost her job. She indicates that she has applied for an extension of her H-1B visa (not quite sure how this is possible if she is no longer working). The husband still has his valid H-1B visa. Is there any option for the wife to get residency through the husband; or must she obtain an H-4 visa in order to do that?
