Hello Dan and all,

Yes, there is space for you to determine that this student meets the requirements for residency, but I would say that it couldn’t apply for the term starting in January 23 because he had not been here for one year at that time.  We are on quarters, so a student in this situation at UW would not qualify for Winter and would need to reapply for Spring.

The section that you have highlighted doesn’t remove the requirement that they are here for one year, but instead means that if they enroll for 6 or more credits in a term during that year, they have to overcome that presumption that they are here primarily for education for the time within that residency year to count.  If you determine that he has given sufficient evidence that his domicile in Washington is for a non-educational purpose, you can make the determination that he has overcome that presumption and count that time toward the one year of domicile.

Also, because he had not maintained his primary address in Washington for the twelve months immediately prior to the start of his first term, he must use the long-form Residence Questionnaire and not the affidavit.

I recently joined this list, and while I have already seen a few excellent & technical questions, I have what I'm sure is probably a very basic one. As a small private school, my residency determinations (ultimately, for WA State Aid purposes) are usually very straightforward, but I have a case that I'm not sure on.

In a review of documents & guidance from WSAC, it seems that an independent student must establish residency by living here for 12 months prior to starting school, but there's a section of WAC 250-18-030 that seems to leave room for exceptions. I've bolded the most relevant passage:


Establishment of a domicile.

The domicile of any person shall be determined according to the individual's overall situation and circumstances and is not determined on the basis of a single factor; nor is a predetermined number of factors required. Institutions shall require evidence of a Washington domicile that is of sufficient quantity and quality to negate the existence of a domicile in a state other than Washington.

A nonresident student who is enrolled for more than six hours per semester or quarter shall be presumed to be in the state of Washington for primarily educational purposes. Such period of enrollment shall not be counted toward the establishment of a bona fide domicile of one year in this state unless such student proves that the student has, in fact, established a bona fide domicile in this state primarily for purposes other than educational. The burden of proof that a person has established a domicile in the state of Washington primarily for purposes other than educational lies with the student.


In short, my student is over 25, financially independent, a citizen, and provided documentation & a supporting statement that he & his family have established full residence in WA and moved here for purposes other than educational. However, his documentation (voter registration, lease, etc.) is dated between Feb. 2022 and March 2022. (he moved her in Feb 2022), and he began full-time attendance at my school at the start of January 2023.

Is there actually room for me to make a determination in this case that the student is a WA resident? Is there anything extra I need to document or do in a case like this? Is there anything else I should be asking?
