Actually, Rand, I think this is the same discussion.  I called the Office of State Procurement years ago and was transferred to someone who had been working there for decades.  He confirmed that we had the right to dispose of de-accessioned books by selling or destroying them.  If we had a book sale, my college required that we accounted for the library materials sold.  Otherwise, they were fine with it.  We could not give the books away, however, unless it was to another state or public entity.  I could give books to another community college library, for instance.

How ironic you are discussing this issue at the same time that we are exploring it. We are having an AAG research this for us. Our authority was an exemption from the Office of State Procurement, now folded into Department of Enterprise Services. Two staff checked with two different DES officials. The first said no the exemption went away with the merger OSP into DES, the other said the exemption still exists and is still reauthorized each biennium. Go figure! I do realize that you have guidelines that are different from ours. Hope I haven't muddied the conversation. Rand

My staff agree with the AG ruling mentioned.  They are under the impression we can dispose of books in any way we choose.  They are searching for correspondence regarding this ruling. Seems that periodically campuses have a change in leadership and new administration may need to be reminded of our ability to classify old books as "waste".

On our campus, weeded books are sent on campus to be shredded and recycled for the most part.  However we have a history of offering BWB a small selection of the more desirable titles.

When I have more details I will share.

Our Business Office says that we can't sell (or give away) discarded library books - they are state property and must follow the surplus property laws.
