 taken to ensure schools do not make it overly burdensome for individuals to report.<o:p></o:p></span></p>

 of the proposed changes for Pierce College to adopt.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D"><o:p> </o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D">Requiring cross-examination in a live hearing is likely to have a chilling effect on reporting, particularly in cases where there is an institutional power imbalance between the complainant and respondent (student/faculty

 or employee/supervisor). <o:p></o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D"><o:p> </o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D">Requiring that notice letters to both complainants and respondents state that the respondent is “presumed not responsible”

<u>and</u> warn against making false statements, taken together, may unintentionally communicate to complainants that the school assumes they are lying. More neutral language such as “no determination has been made at this time” regarding responsibility may

 help preserve due process without alarming complainants and/or potentially prompting them to withdraw their complaint.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D">The proposed regulations require that the standard of evidence used for complaints against students be the same as that used for complaints against faculty. Employees, and specifically tenured faculty members,

 have rights related to their employment that do not apply to students. Employment policies or collective bargaining agreements may or may not specify a “standard of evidence” to be used, but they do provide specific rights and obligations related to the employment

 will likely decrease; however, schools’ costs and obligations when responding to formal complaints will likely increase. Title IX Coordinators will likely spend substantial time on supportive measures, meeting with complainants, and administrative record-keeping,

 and less time overseeing investigations. (This may be a change for some schools, but not others.)<o:p></o:p></span></p>

 issues are of particular concern. The expertise, or lack thereof, of the advisors will have a major impact on the proceedings and those parties without resources will be at a significant disadvantage. Low-income students, or the colleges, are unlikely to be

 able to fund an advisor to match a highly experienced attorney.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D">Just wanted to chime in on behalf of Skagit Valley College.  In consultation with out Title IX Coordinator, we are in agreement with all previously expressed concerns, summarized as:<o:p></o:p></span></p>

</span></span></span><![endif]><span style="color:#1F497D">Significant concerns relating to Due Process requirements, specifically noting

<u>deterrent effects on reporting</u>, <u>staffing limitations</u>, and <u>relaxed obligations of institutions to investigate</u>.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D"><o:p> </o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D">Specific concerns are highlighted below in yellow.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D"><o:p> </o:p></span></p>

<p class="MsoNormal" style="margin-bottom:8.25pt;background:white"><b><u><span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">Due Process Requirement:</span></u></b><span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">  As a small college,

 our Title IX resources are already stretched thin and the new Due Process Requirements would require us to identify up to three (3) individuals for disciplinary proceedings AND we would be responsible for providing an Advisor for parties that do not or cannot

 bring their own.  In addition, the hearings would allow cross-examination.  This feels too much like a court setting, and we (Student Services and Title IX Coordinator(s)) would need considerable training to ensure that parties are not further harassed or

 harmed by the proceedings.    I am afraid that the cross examination requirement will deter people from bring forward complaints as they may be forced to face the respondent.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="font-size:10.0pt;font-family:"Tahoma",sans-serif"><o:p> </o:p></span></p>

<p class="MsoNormal" style="margin-left:.5in"><span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">Disciplinary proceedings must involve many things that colleges likely are doing already, such as providing sufficient and timely notice of relevant

 actions to both parties. But for many community colleges, especially smaller institutions, some of the new requirements may go beyond current practice.

<span style="background:yellow;mso-highlight:yellow">For instance, the Title IX coordinator, investigator, and decision maker (or makers) for any given case must all be different people. The “single investigator” model, where one person plays more than one

 of these roles, would no longer be allowed, potentially straining personnel resources at smaller institutions.</span> In addition, colleges must make the final determination in a case in a live hearing where the parties, through their advisors, have the option

 to cross-examine one another. <span style="background:yellow;mso-highlight:yellow">

If one of the parties does not have an advisor, the institution must provide one.</span><o:p></o:p></span></p>

<p class="MsoNormal" style="mso-margin-top-alt:0in;margin-right:0in;margin-bottom:8.25pt;margin-left:.5in;background:white">

<span style="font-size:10.0pt;font-family:"Tahoma",sans-serif"><o:p> </o:p></span></p>

<p class="MsoNormal" style="margin-bottom:8.25pt;background:white"><b><u><span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">Reports and Formal Complaints</span></u></b><span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">:  Prior regulations

 made it easier for complainants to inform institutions of complaints. The new language would require  a “formal complaint” process and the need to report to the Title IX Coordinator, and not just an agent of the college.   Right now students can report complaints

 to faculty, staff, and administrators who then convey the information to the Title IX Coordinator or at least Maxient. I am afraid that the new reporting requirement will deter people from bring forward complaints.<o:p></o:p></span></p>

<p class="MsoNormal" style="mso-margin-top-alt:0in;margin-right:0in;margin-bottom:8.25pt;margin-left:.5in;background:white">

<span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">As is now the case, an institution is obligated to respond to all reports (under the narrower set of circumstances described above) of activity that meets the definition of sexual harassment and

 takes place within its education program or activity. <span style="background:yellow;mso-highlight:yellow">

The proposed regulations distinguish between reports and “formal complaints,” which are documents signed by the complainant or, in some circumstances, the Title IX coordinator. Only upon the filing of a formal complaint is an institution obligated to launch

 a formal investigation and use its grievance procedures.</span><o:p></o:p></span></p>

<p class="MsoNormal" style="mso-margin-top-alt:0in;margin-right:0in;margin-bottom:8.25pt;margin-left:.5in;background:white">

<span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">For reports that are not formal complaints, the institution must still respond, and the regulations put forth “supportive measures” that the institution may wish to offer the complainant (and respondent)

 student. These services, similar in concept to “interim measures” under previous guidance, must be non-disciplinary and at no cost to the students. The measures described in the regulation include counseling, mutual restrictions on contact between the parties,

 leaves of absence, increased security, and other measures.  The preamble to the regulation cites employment of these measures as a means of avoiding a more protracted and potentially charged proceeding.<o:p></o:p></span></p>

<p class="MsoNormal" style="margin-bottom:8.25pt;background:white"><b><u><span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">Actual Notice<o:p></o:p></span></u></b></p>

<p class="MsoNormal" style="margin-bottom:8.25pt;background:white"><span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">The change in notice requirements, will also limit the number of complaints filed as students develop strong bonds with student

 services and instruction staff and often feel safest reporting situation to them.  In this new model, the college would only have to respond to actual notice of incidents.<o:p></o:p></span></p>

<p class="MsoNormal" style="mso-margin-top-alt:0in;margin-right:0in;margin-bottom:8.25pt;margin-left:.5in;background:white">

<span style="font-size:10.0pt;font-family:"Tahoma",sans-serif">One of the most substantial changes in the proposed regulations details when an institution is deemed to have notice of possible sexual harassment to which it has an obligation to respond. Under

 current regulations and guidance, this obligation is triggered when a college knows or should have known about the possible harassment. Under the proposed regulations,

<span style="background:yellow;mso-highlight:yellow">the institution only has an obligation to respond under Title IX when it has actual notice of an alleged incident</span>. This only occurs when a report is made to the institution’s Title IX coordinator or

 another employee who has authority to take corrective action on behalf of the institution. This stands in stark contrast to current practice, where a report to any “responsible employee” triggers an obligation to respond. In practice, many colleges have determined

 that a wide swath of their employees are “responsible employees,” including adjunct professors. The new regulations may spur colleges to reexamine their policies in this area.<o:p></o:p></span></p>

<p class="MsoNormal"><span style="color:#1F497D">My major areas of concern pertain to the Due Process Requirements, which I think will have and may have been designed to have a deterrent effect on reporting, as well as moving the hearing process in a decidedly

 litigious and quasi-jurisprudential direction.  Taking the latter concern first, the requirement to allow cross-examination of evidence and the requirement to provide an advisor (aka, counsel) are going to increase legal exposure of institutions to lawsuits

 and will likely result in many institutions moving away from hearing panels staffed by administrators and faculty in the direction of hiring administrative judges to handle TIX cases.  As to the first concern, the same barriers that deter survivors of sexual

 assault/misconduct from reporting in a legal/criminal context will now essentially be replicated in a putatively student conduct context.<o:p></o:p></span></p>
