<p class="MsoNormal"><span style="font-size:12.0pt"></span><span style="color:#1F497D">Colleagues: the group developing a legislative concept for a bill exempting Student Conduct Code procedures from the APA has decided NOT to go forward with legislation at
this time. They noted that a federal district court ruling in Michigan (District 6) held that University of Michigan’s use of the “report model” (as opposed to a hearing model allowing direct cross-examination) violated the due process rights of the student
accused of misconduct. Since the legislative concept being developed here in Washington was largely based on the report model, they felt it was necessary to see how this plays out in the courts for now.
