Subject: State v. DeVos, et al. (CARES Act) - Order Granting Motion for Preliminary Injunction

This afternoon the federal district court in Spokane granted our motion for preliminary injunction against the U.S. Department of Education in our lawsuit concerning student eligibility restrictions for CARES Act emergency financial assistance grants. A copy of the Order is attached. The Court’s order states:

“The United States Department of Education, Secretary of Education Betsy DeVos, and their officers, agents, servants, employees, attorneys,
and any person in active concert or participation with them, are hereby preliminarily enjoined from implementing or enforcing the provisions
in the April 21, 2020 guidance and the Interim Final Rule that restricts the discretion of higher education institutions in the State of Washington
to determine which students will receive CARES Act student emergency financial assistance grants to only those students who are eligible for
federal financial aid under Title IV, section 484 of the Higher Education Act, in any manner or in any respect.”
