Greetings All,

I am sharing with you all the Accessibility Rider Monica is requesting we ask Canvas to include in the contract renewal. Abraham Rocha, SBCTC's contract lawyer, has had a chance to review and believes it is a starting point for negotiations as we look to extend services to them.

I look forward to discussing the next steps at this month's ETAG meeting. Maggie will be sending that invite for 1/24/24.



Compliance with Civil Rights Laws (pp. 19-20)
During the performance of this Contract, Vendor shall comply with all federal and applicable state
nondiscrimination laws, including but not limited to: Title VII of the Civil Rights Act, 42 U.S.C. §
12101 et seq.; the Americans with Disabilities Act (ADA); and Title 49.60 RCW, Washington Law
Against Discrimination.

comply with any nondiscrimination law, regulation or policy, this Contract may be rescinded, canceled, or
terminated in whole or in part under the Termination for Default sections, and Vendor may be declared
ineligible for further contracts with Purchaser.

Proposed Accessibilty Rider for Instructure Contract Renewal

 In accordance with Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act of 1990 (ADA)<https://www.ada.gov/pubs/adastatute08.htm>, and the Amendments Act of 2008, SBCTC is obligated to provide access to its programs, activities, and services to people with disabilities. SBCTC must ensure that its IT products, programs, and services are accessible to people with disabilities in accordance with Washington State Policy 188<https://ocio.wa.gov/policy/accessibility>. “Accessible” means to provide substantially similar functionality, experience, ease of use, and information access to people with disabilities as is provided to people without disabilities.


Instructure will provide SBCTC with a completed Accessibility Compliance Report (ACR) documentation as assurance and verification of the status of accessibility conformance to WCAG 2.1AA technical standards for the Canvas product. Parties agree that the current Voluntary Product Accessibility Template (VPAT) document at version level 2.3 or higher (available at https://www.itic.org/policy/accessibility/vpat<https://www.itic.org/policy/accessibility/vpat>) will satisfy this requirement. SBCTC may opt to conduct an independent/third-party accessibility assessment of the accessibility of Contractor’s works at any time but will not be held responsible for doing so.

 If any of the Contractor’s products or services within this Agreement are not in conformance with WCAG 2.1 AA technical standards as required by SBCTC, then the Contractor shall undertake in good faith to resolve such issues and promptly respond to concerns made by SBCTC about accessibility. Whenever possible, the Contractor shall provide updates with timelines (e.g. Accessibility Roadmap) for expected accessibility remediation work.
