I write to share that as we commemorate the 50th Anniversary of Title IX of the Education Amendments of 1972, the Department has released for public comment its proposed amendments to the Department’s regulations implementing Title IX.

The proposed regulations aim to ensure full protection under Title IX for students, employees, and others, and end all forms of sex discrimination, including sex-based harassment and sexual violence, in federally funded elementary schools,
secondary schools, and postsecondary institutions. The Department’s goal is to ensure that no
person experiences sex discrimination in education, that all students receive appropriate support as needed to access educational opportunities, and that school procedures for investigating and resolving complaints of sex discrimination, including sex-based
harassment and sexual violence, are fair to all involved. The proposed regulations would also clarify Title IX’s coverage of discrimination based on sexual orientation and gender identity, as well as sex stereotypes, sex characteristics, and pregnancy or
related conditions.

In developing these proposed regulations, the Department benefited from the comments of a wide array of interested persons. We heard from teachers, professors, school administrators and leaders, advocates, parents, and many others through
our first-ever nationwide virtual public hearing on Title IX. Commenters shared with us their insights, experiences, and hopes for how to fulfill Title IX’s promise of an educational environment for all that is free from sex discrimination. We thank you
again for this important input, and we now invite you, and all members of the public, to read the proposed regulations and share your views on how the Department’s Title IX regulations can best assist recipients in meeting their Title IX obligations.

The Department’s proposed amendments to its Title IX regulations will be open for public comment for 60 days from the date of publication in the Federal Register. Comments must be submitted via the Federal eRulemaking Portal at
